法律社会观下的冲突与选择——评《中国法律与中国社会》

Conflict and choice in the view of legal society——On Chinese law and Chinese Society

瞿同祖先生《中国法律与中国社会》一书,是其对社会史和法律史综合研究的成果。分析了中国法律的主要特征和基本精神,并阐明法律的目的在于保障社会秩序的稳定。该书从三组不同层面上的观念冲突展开论述,即伦常与是非的冲突、家族主义与国家主义的冲突、差别性规范与同一性规范的冲突,以呈现中国法律在社会价值要求下所做出选择的过程。结合瞿同祖先生的法律社会学观念,对现今社会与法律的冲突成因加以探讨,以期获得中国法治建设方面的启迪。

The book“Chinese Law and Chinese Society”by Qu Tongzu is the result of his comprehensive research on social history and legal history.It mainly analyzes the main characteristics and basic spirit of Chinese law,and clarifies that the purpose of law is to guarantee the stability of social order.Based on this understanding,the author abstracts three groups of Conflicting concepts from different levels in this book,namely the conflict between ethnic and right--wrong,the conflict between familism and nationalism,and the conflict between the norms of difference and identity,in order to present the process of Chinese Law’choice under the requirements of social values.Finally,this paper,combining with Qu Tongzu's concept of legal sociology,discusses the causes of the conflict between society and law in order to gain enlightenment on the construction of the rule of law in China.
