摘要
《中华人民共和国基本医疗卫生与健康促进法》对医疗机构管理和医务人员提出了新的要求,尤其是在该法律文本中有多处提到了伦理、伦理审查和伦理规范。从伦理学角度解读《中华人民共和国基本医疗卫生与健康促进法》,以利于全面学懂弄通该法律条文,为依法履职提供法律遵循。该法律对知情同意的要求更具体、灵活;从之前的《中华人民共和国侵权责任法》中的不得过度检查扩大到现法律规定的不得过度医疗;将对隐私权的保护上升到公民个人健康信息安全;对伦理规范的要求更具体,对违反医学伦理行为的处罚也更明确。
The Law of the People’s Republic of China on the Promotion of Basic Medical and Health Care puts forward new requirements for the management of medical institutions and medical personnel,especially in the text of the law,there are many references to ethics,ethical review and ethical norms.This paper interpreted the Law of the People’s Republic of China on the Promotion of Basic Medical and Health Care from the perspective of ethics,in order to comprehensively understand the legal provisions and provide legal compliance for the performance of duties according to law.The requirements of informed consent are more specific and flexible.The previous“Tort Law of the People’s Republic of China”of“No Excessive Examination”has been revised to“No Excessive Medical Treatment”;the protection of privacy will rise to the safety of citizens’personal health information;the requirements for ethical norms are more specific,and the penalties for violating medical ethics are also clearer.
