摘要
网络直播繁荣表象的背后存在着严重危害社会的行为,刑法对之关切不足,以致侦查工作的思维模式和技术运用皆受到治理需求的现实考问。当前,公安机关在打击网络直播中的犯罪时面临犯罪甄别难、法律适用难、证据获取难、实地抓捕难、赃款追返难等困境。应对网络直播中的犯罪的高发态势,国家职能机构应当秉持数据思维,创新侦查模式;总结办案经验,深化经营意识;完善侦查协作,强化内外联动;拓宽阵地控制,加强队伍建设;完善法律法规,创新监管方式。
The prosperous live webcast has behaviors that seriously endanger the society,and the criminal law is not concerned about them,so that the thinking mode and technical application of investigative work are tested by the needs of governance.Currently,the public security organs are encountering difficulties in identifying crimes,applying the law,obtaining evidence,arresting on the spot,and recovering stolen money when fighting crimes in live webcasts.To cope with the high incidence of crimes in live webcasts,state functional agencies should uphold data thinking and innovate investigation models;summarize case handling experience and deepen business awareness;improve investigation collaboration,strengthen internal and external linkages;broaden position control,strengthen team building,improve laws and regulations,and innovate supervision method.
