在法庭上殴打诉讼参与人的管辖权探讨

摘要 司法实践中,在法庭上殴打诉讼参与人属于妨害民事诉讼秩序的违法行为,一般由人民法院直接行使管辖权。但也有受害人选择报警由公安机关依法受理的情形,此时往往会引发管辖权争议。为了阐述上述问题,文章采用法理分析和案例分析的方法,对管辖权争议和一事不再罚进行探讨。人民法院对上述违法行为享有法定的管辖权,只要公安机关的处罚与人民法院的处罚不违反一事不再罚的原则,公安机关也享有相应的管辖权。从保护受害人的角度出发,对于上述违法行为,人民法院和公安机关都应该享有管辖权。 In judicial practice,beating a assaulting participant in court is an illegal act that disrupts the order of civil proceedings,and generally the people’s court directly exercises its jurisdiction.However,there are also victims who report to the police and are accepted by the public security organs in accordance with the law,triggering disputes over jurisdiction.For the above-mentioned issues,the article uses legal analysis and case analysis to discuss jurisdictional disputes and no more punishment.The people’s courts have statutory jurisdiction over the above-mentioned acts.As long as the punishments imposed by the public security organs and the people’s courts do not violate the principle of no more punishment for one thing,the public security organs also have jurisdiction.From the perspective of protecting victims,the people’s courts and public security organs should have jurisdiction over the above-mentioned illegal acts.
