突发公共卫生事件应急管理省级立法现状研究

Study on provincial legislation of emergency management of public health emergencies

法律是公共行政管理的最高准则,应对突发公共卫生事件,既要依靠科学,又要依靠法治。纵观我国现阶段各省级公共卫生应急管理立法,存在着立而不修、操作性不强、法律层级低、缺乏地方特色等诸多问题。通过分析当前立法存在的问题,创新法治思维,探索符合各区域治理特色的立法优化途径,从法治层面予以更有效的保障,寻找优化省级立法的方向,以此推进各项公共卫生应急管理体系在法治轨道上的统筹发展。

Law is the highest criterion of public administration.To respond to public health emergencies,we must rely on both science and the rule of law.Throughout current stage of public health emergency management legislation,there are many problems such as legislation but unamended,insufficient operability,low law hierarchy,lack of local color,etc.By analyzing the problems existing in current legislation,innovating the thinking of the rule of law,exploring the legislative optimization ways in line with the characteristics of regional governance,providing more effective protection from the rule of law,and looking for the direction of optimizing the provincial legislation,so as to promote overall development of public health emergency management system on the track of the rule of law.
