摘要
“小产权房”的出现根源于旧的《土地管理法》对集体土地上市流转的限制。新修订的《土地管理法》为集体经营性建设用地上市流转提供了法律保障,有效解决了“小产权房”的问题。在对历史上形成的“小产权房”的处理上不能一概而论,应从建造和流转两方面分类解决。为防止农村集体土地处分流转的随意性,应从明确集体土地所有权的权利主体和完善土地征收制度两方面解决。
The emergence of"incomplete property right house"is rooted in the restriction of the old"land management law"on the listing and circulation of collective land.The newly revised"land management law"provides legal guarantee for the listing and circulation of collective operating construction land,and effectively solves the problem of“incomplete property right house”.We can't generalize the treatment of“incomplete property right house”formed in history.We should solve it from two aspects of construction and circulation.In order to prevent the randomness of the disposal and transfer of rural collective land,we should clarify the right subject of collective land ownership and improve the land expropriation system.
