摘要
新修改的《土地管理法》首次列举了土地征收公共利益用地情形,但是对于如何判断具体项目是否符合法律规定的情形,相关法律尚未作出具体规定。对此,本文首先梳理了新《土地管理法》中关于土地征收公共利益的法律规定;其次,分析了建立公共利益认定机制的必要性;然后,对美国、日本、我国台湾地区在土地征收公共利益认定机制的做法进行了梳理;最后,提出了完善我国土地征收公共利益认定机制的意见和建议。
The newly revised Land Management Law lists for the first time the circumstances of land acquisition for public interest,but the relevant laws have not yet provided for how to judge whether a specific project meets the circumstances stipulated in the law.In this regard,this paper firstly reviews the legal provisions of the Land Management Law on the land acquisition of public interest.Secondly,it analyzes the need for establishing the mechanism for identifying public interest.Thirdly,the paper sorts out the mechanisms for identifying public interest in land acquisition in the United States,Japan and Taiwan Region of China.Finally,suggestions and recommendations are put forward to consummate the mechanism for identifying the public interest in land acquisition in China.
