长租公寓“爆雷”背景下的租客权益保护——以蛋壳公寓为例

Protection of Tenants’Rights in“Rapid Expansion”of Long-term Rental Apartments:Taking Egg-shell Apartments as an Example

2020年末蛋壳公寓爆雷事件引发广泛关注。长租公寓在快速扩张的过程中需要消耗大量资金,形成了“高收低租”“长短错配”的运营模式,并且引入了金融创新产品租金贷,将其对租客的债权快速变现融资。租金贷产品加重了租客的负担,在推广过程中还存在隐瞒、欺诈等行为侵犯了租客的知情权。长租公寓爆雷后,租客并无过错却要陷入无房居住、继续还租金贷款的两难窘境,租客权益应当得到保护。从法律关系上租客通过债权让与给贷款人,以抵销偿还贷款义务方式具有可行性,同时可积极探索将域外消费信贷关联合同制度引入租金贷中,以期未来更好地保障租客利益。

The thunder explosion of Danke apartments in the country at the end of 2020 has aroused concern.Long-term rental apartment needs a lot of money in the process of rapid expansion,which forms a“high income and low rent”and“long and short mismatch”business model.This paper holds that the rent loan products increase the burden of the tenants,and there are some acts of concealment and fraud in the promotion process,which violate the tenants’right to know.This paper demonstrates the feasibility of the tenants transferring their creditor’s rights to the lenders in order to offset the repayment obligation of the loans.In order to better protect the interests of the tenants in the future,we should actively explore the introduction of consumer credit related contract systems into rental loans.
