摘要
生态环境损害赔偿磋商程序为环境问题提供了软性治理方式,但磋商程序自身仍有证据获取难、监督缺失、强制执行依赖司法力量等不足。公证机构作为带有中立性质的法律服务机构,在磋商程序中能够调和公私主体的紧张关系,同时能够补强磋商程序在举据、监督、执行等环节的薄弱之处。
The consultation procedure of ecological environmental damage compensation provides a soft way to deal with environmental problems.However,the consultation procedure itself still has some shortcomings,such as evidence acquisition,lack of supervision,and dependence on judicial force for enforcement.As a neutral legal service organization,notarization can reconcile the tension between public and private entities in the negotiation process,and strengthen the weakness of the negotiation process in the aspects of evidence,supervision and implementation.
