摘要
随着互联网技术的不断完善和发展,网约车作为“互联网+交通”的产物应运而生且蓬勃发展.目前,我国网约车立法在市场准入问题上存在着合法性欠缺、地方网约车管理细则设定的准入门槛过于严格、保险制度存在缺陷,以及准入许可得不到良好落实等弊端,需要从提高网约车中央立法层级、降低车辆与驾驶员准入门槛、建立分段式保险制度,以及加强事前、事中、事后监管等方面予以解决.
With the continuous improvement and development of Internet technology,as a product of"Internet+transportation",Internet-based taxis have emerged and flourished.At present,there exist problems with China's car-hailing market access mechanism,including lack of legitimacy,high barriers to entry,flaws in the insurance system and poor implementation of access permits.Therefore,it should be solved by improving the central legislative level of online car-hailing,reducing the barriers to entry for vehicles and drivers,establishing a segmented in-surance system and strengthening supervision of the entire process.
