摘要
标准必要专利是实施技术标准必须使用的专利。标准必要专利具有不可替代性和锁定性,构成必需设施,具有公共利益属性。借助标准必要专利的特殊法律属性,专利权利人会拥有很强的谈判优势和市场支配力,标准必要专利易于产生挟持和许可费堆积问题。鉴于标准必要专利的特殊法律属性,对标准必要专利的法律规制不能与普通专利相同。专利法、反垄断法等应当对标准必要专利进行特殊、严格的法律限制,以预防和减少标准必要专利挟持的发生和许可费堆积。
Standard essential patents are patents that must be used to implement technical standards.Standard es⁃sential patent has irreplaceable and the lock-in nature,constitutes the Essential Facilities,and has public inter⁃est attribute.With the special legal attributes of standard essential patents,patent holders will have strong negoti⁃ation advantages and market power,and standard essential patents are prone to the problem of holdup and royal⁃ty stacking.In view of the special legal attributes of standard essential patents,the legal regulation of standard es⁃sential patents cannot be the same as ordinary patents.In order to prevent and reduce the occurrence of standard necessary patent holdup and royalty stacking,patent law,antitrust law and so on should impose special and strict legal restrictions on the standard essential patents.
