金融科技视阈下金融基础设施域外适用的法治保障

The Rule of Law Guarantee of Extraterritorial Application of Financial Infrastructure from the Perspective of Financial Science and Technology

金融基础设施是金融体系的“骨架”,它具有中立性、弱替代性、技术性、系统重要性等特点。金融科技背景下,金融基础设施呈现出数字化、智能化的特点,内含着强大的技术性交易规则。在一定意义上,金融基础设施的域外输出就意味着某国金融法的域外适用。缘于我国金融基础设施法律规范缺乏顶层设计、技术规范有待优化、金融监管存在短板,致使金融基础设施的域外适用范围有限。促进金融基础设施的域外适用,应优化金融基础设施的法律规则体系,提升金融基础设施的数字化水平,健全金融基础设施的运营环境,重视金融基础设施立法在国际法上的“合法性”。

Financial infrastructure is the"skeleton"of the financial system,which has the characteristics of neutrality,weak substitution,technology and systemically important.In the context of FinTech,financial infrastructure presents a digital and intelligent development trend,which contains strong technical trading rules.In a sense,the extraterritorial export of financial infrastructure means the extraterritorial application of a country's financial law.Due to the lack of top-level design of China's financial infrastructure laws and regulations,the need for optimization of technical specifications,and the shortcomings of financial supervision,the scope of external application of financial infrastructure is limited.To promote the extraterritorial application of financial infrastructure,the legal and rule system of financial infrastructure should be optimized,the digital level of financial infrastructure should be improved,the operating environment of financial infrastructure should be improved,and the"legitimacy"of financial infrastructure legislation in international law should be emphasized.
