行政案件繁简分流模式实证研究

Empirical Study on the Pattern of the Division Between Complex and Simple in Administrative Cases

在受案范围扩大、立案登记制实施、管辖制度改革等三重因素的作用下,行政诉讼案多人少矛盾突出,严重影响人民司法需求的满足。可以优化司法资源配置、更好保障行政诉权的行政案件繁简分流改革应运而生,成为行政诉讼制度改革的重要举措。实践探索中形成的行政案件诉前案件过滤模式、审前程序分流模式、案件分类审理模式等三种模式,整体呈现出层层递进、多次分流的“漏斗式”特征。未来应坚持“大繁简、大分流”理念,正确处理好司法效率与司法公正的关系,充分利用科技手段,推动行政案件繁简分流改革进一步发展。

Under the influence of three factors,such as the expansion of the scope of acceptance of cases,the implementation of the registration system for filing cases,and the reform of the jurisdiction system,the shortage of judges in background that administrative lawsuits are rapidly increasing is prominent,which seriously affects the satisfaction of people’s judicial needs.The reform of streamlining administrative cases that can optimize the allocation of judicial resources and better protect the administrative rights of litigation has emerged as the times require,and has become an important measure for reforming the administrative litigation system.The three modes,such as pre-litigation case filtering mode,pre-trial procedure shunting mode,and case classification trial mode formed in the practical exploration,have shown the“funnel-like”characteristics of progressive layers and multiple shunts.In the future,we should adhere to the concept of“big simplification,big diversion”,correctly handle the relationship between judicial efficiency and judicial fairness,make full use of scientific and technological means to promote the further development of the reform process of administrative cases.
