检察机关指导性案例编撰研究

目前,检察机关指导性案例中存在标题的指导性作用不大,关键词的关键性不够强,要旨提炼不够精,基本案情表达不够准,检察履职过程体现不足等情形。为完善上述情况,在实质内容方面,必须坚定编撰目标、把准编撰定位、坚守编撰原则、严格入选标准、强化论证说理、注重自身检察职能的发挥。在形式体例结构方面,应充分展现标题中的案例特性、找准关键词、精确基本案情陈述、充分展示诉讼过程中的检察职能、精准提炼要旨。通过不断提高检察机关指导性案例的实质内容质量和完善形式体例结构,编撰出优质的指导性案例,为统一司法适用标准、规范司法行为、解决法律适用中的疑难问题、开展以案释法等方面发挥检察机关指导性案例的指导作用。

At present,there exist some problems in the guiding cases of procuratorial organs,such as that the guiding role of the title is not great,the key words are not strong enough,the essence is not refined enough,and the expression of the basic case is not accurate enough,the situation of the procuratorial performance process is embodied insufficient and so on.In order to improve the above situation,in terms of substantove content,we must firmly hold the goal of compilation,orientate compilation accurately,stick to the compilation principle,select the standard strictly,strengthen demonstration and reasoning,and pay attention to the play of our own procuratorial function.In terms of the structure of form and style,the characteristics of the case in the title should be fully displayed,the key words should be accurately identified,the basic facts of the case should be accurately stated,the procuratorial function in the process of litigation should be fully displayed,and the essence of the case should be accurately refined.Through constantly improving the substance,form and structure of guiding cases of procuratorial organs,high-quality guiding cases are compiled to play a guiding role in unifying the standards of judicial application,standardizing judicial acts,solving difficult problems in the application of laws,and carrying out the interpretation of law by case.
