我国企业程序出罪机制的多层级构建

A Multi-layered Construction of a Mechanism for the Incrimination of Chinese Enterprises'Procedures

刑事企业合规制度目前在各地相继试点,意图促进民营企业的发展、避免水波效应、优化营商环境、稳定市场秩序,该制度在我国引入的必要性已经是毋庸置疑了,但是刑事企业合规制度究竟以何种方式引入、将其放置于《刑事诉讼法》篇幅中的何处仍然值得学界探讨。将该制度置于企业程序出罪的框架下予以研究,探索企业程序出罪的一个新通道,结合我国实际再参考国外制度对该制度的具体流程和操作进行本土化改造,选择适用暂缓起诉制度,对认罪认罚赋予新内涵,限定罪名范围,完善监督体系。

The criminal enterprise compliance system is being piloted around the world,with the intention of promoting the development of private enterprises,avoiding the water-wave effect,optimizing the business environment and stabilizing the market order.It is no doubt necessary to introduce the system in China,but how it is introduced and where it is to be placed in the Criminal Procedure Law is still worthy of discussion.The author attempts to place this system under the framework of corporate criminality,and to explore a new channel of corporate criminality.Considering the reality in China and the specific process of the foreign systems,we should look to achieve localization of the system,select an appropriate system of deferred prosecution,gain a new connotation to the plea of guilty,limit the scope of the crime and eventually to improve the supervision system.
