生态文明与信息文明双轨并存发展时代的环境信息法与绿色原则看似不相关联的两个法律话题,实质上二者有紧密的内在联系。环境信息法主要阐明法工具适用即法技术供给层面的规范思考,绿色原则主要突出法价值导向即目的观念式的规范思考,二者在存在意义上具有内在一致性,环境信息法可为绿色原则提供必要的制度保障,绿色原则使环境信息法真正有了用武之地。然而,现行环境信息法助推绿色原则仍存在权利监督工具不全、核心价值理念缺失、制度规制合力不足、制度体系效果不佳等诸多困境,这就需要拓展公众环境信息权范畴、厘清环境信息法的基本原则、构建完备的环境信息规范体系、推动环境信息法立法模式改革,为全面践行绿色原则提供必要的信息制度支撑。

The environmental information law and the green principle in the dual-track development era of ecological civilization and information civilization are two unrelated legal topics on the surface,but in fact they are closely related.The environmental information law mainly clarifies that the application of legal tools is the normative thinking at the level of legal technology supply.The green principle mainly highlights the normative thinking of a legal value orientation,that is,the goal concept.The two are inherently consistent in the sense of existence:the environmental information law can provide the necessary institutional guarantees for the implementation of the green principle,and the implementation of the green principle has made the environmental information law play its role.However,there are still many difficulties in the current environmental information law to promote the implementation of the green principle,such as incomplete rights supervision tools,lack of core value concepts,insufficient institutional regulations,and inefficient institutional systems.To solve these difficulties requires expanding the scope of public environmental information rights,clarifying the basic principle of the environmental information,the establishment of a complete environmental information standard system,and promoting the legislative model reform of the environmental information law,so as to provide the necessary information system guarantee for the full implementation of the green principle.
