《退役军人保障法》的颁布,标志着我国退役军人社会保险法律制度体系的基本确立。退役军人社会保险法律制度包括养老、医疗、失业、伤亡等制度。其存在的问题主要有:法规制度存在交叉,内在逻辑不清晰;未实现保障对象全覆盖,保障水平不高;缺乏科学合理的管理体制和军地衔接机制。完善我国退役军人社会保险法律制度的路径是:完善法律制度体系,实现保险种类多样化;将退役军人保险业务纳入社会化运作,引入竞争机制;构建军地有效衔接的退役军人保险机制。

The promulgation of the Security Law for Ex-servicemen marks the establishment of the legal system of social insurance for ex-servicemen in China.It includes systems of pension,health care,unemployment and casualty.Its existing problems are:the laws and regulations are intersecting without clear internal logic;it fails to fully cover and the security level is not high;it lacks of scientific and reasonable management and military-civilian linkage mechanism.The ways to perfect the legal system of social insurance for ex-servicemen are as follows:perfecting the legal system and realize the diversification of insurance types;socializing the ex-servicemen's insurance business and introducing competition mechanism;establishing an military-civilian insurance mechanism.
