One Hundred Years’Practice and Rule of Law Experience of the Communist Party of China’s Inner-Party Regulations’System

治国必先治党,治党必依党规。中国共产党的党内法规体系是中国特色社会主义法治体系的一部分,依规治党与依法治国共同构成了法治中国的法治实践。中国共产党党内法规体系建设历经百年,从建章立制的启蒙期、筚路蓝缕的摸索前行期、制度治党的体系构建期,到依规治党的法治实践期,走过了一条逐步法治化的道路。总结党内法规体系建设的法治经验,制度治党与依规治党构成了党内法规体系的法治化模式;宪法为上与党章为本是其法治遵循与制度准则;坚持依规治党与依法治国有机统一保障了党内法规的法治体系化;党内法规与国家法律的衔接与协调是党内法规体系的主要法治路径;使命型政党的自我制度革命构成了党内法规体系的法治目标。

To govern the country,we must first govern the Party,and to govern the Party,we must follow party rules.The CPC’s inner-party regulations’system is an important part of the socialist legal system with Chinese characteristics.Governing the Party in accordance with regulations and governing the country by law constitute the two major legal practices of the rule of law in China.The construction of the inner-party regulations’system has gone through a hundred years,from the enlightenment period of the establishment of rules and regulations,the difficult explorative period,the system construction period of institutional governance of the Party,to the legal practice period of governing the Party in accordance with rules,and has gone through a road of gradual rule of law.According to the rule of law experience of the inner-party regulations’system,the rule of law model of the inner-party regulations’system is formed by institutional governance of the Party and governing the Party according to regulation;the constitution and the party constitution are the norms of the rule of law and the institution of the inner-party regulations’system;the organic unity of governing the Party according to regulations and governing the country by law guarantees the systematization of the rule of law of the inner-party regulations;the connection and coordination between the inner-party regulations and national laws is the main legal path of the inner-party regulations’system;the self-institutional revolution of the mission-type party constitutes the goal of the rule of law of the inner-party regulations’system.
