论民法典融入“思想道德修养与法律基础”课程的价值、问题与实践逻辑

摘要 民法典是"中国之治"的法治丰碑,如何使民法典更好地融入"思想道德修养与法律基础"课程,充分发挥其独特的育人作用,需要正确认识并准确把握民法典融入"思想道德修养与法律基础"课程的价值、问题和实践三重逻辑。第一,充分理解民法典在促进"思想道德修养与法律基础"教学、推动国家治理现代化、提升大学生法治素养中的重大意义;第二,逐步厘清民法典在价值、方法、知识层面所体现的由表及里的现存阻碍;第三,从新发展理念的角度论述民法典融入"思想道德修养与法律基础"的具体实践逻辑。 The Civil Code is a monumental masterpiece of Governance in China.To better integrate the Civil Code in the course of"Ideological and Moral Cultivation and Law Fundamentals"and give full play of its unique effect of education,it is needed to have correct recognition and accurate master of the triple logic,i.e.value,problem and practice of such integration.Firstly,make full sense of the crucial significance of the Civil Code in promoting teaching of"Ideological and Moral Cultivation and Law Fundamentals",driving modernization of national governance and elevating rule-of-law awareness of college students.Secondly,gradually clear up the interior and exterior obstacles existing against the Civil Code on the aspects of value,method and knowledge.Thirdly,discuss the specific practice logic of such integration from the viewing point of new developmental philosophy.
