公园城市理念下城市景观风貌立法探究——基于国内外景观风貌立法的对比性研究

The Research of Urban Landscape Management Legislation:Based on Comparative Case Studies of the Landscape Legislation in Domestic and Foreign Countries

城市景观风貌是提升城市竞争力、增强城市软实力的重要抓手。2018年“公园城市”理念的提出,对城市特色塑造、城市景观风貌立法规制提出更高的要求。基于对立法必要性和新要求的基本认识,创新性地探讨“公园城市”理念下景观风貌的内涵特征和立法法理基础。同时系统性地对既有国内外立法实践开展对比性研究,以“公园城市”理念审视其实施成效,探讨当前新发展理念下,景观风貌立法的3大重点,以期为未来的城市景观风貌立法研究及工作实践提出新的思路和方向。

The city landscape is an important instrument to promote urban competitiveness.In 2018,the concept of"park city"has been put forward,which made a higher requirement for urban landscape legislation.Based on the basic understanding of legislative necessity and new requirements,this paper discusses the connotation characteristics and legislation foundation of the"park city"concept,while conducting systemic comparison research on existing legislative practices at home and abroad.Taking the"park city"concept to examine their implementation,this paper discusses three focuses on the current development concept and the landscape legislation,with a view to present new ideas and directions in the future urban landscape legislation.
