摘要
"一房二卖"纠纷中部分案件涉及民刑关于民事欺诈与合同诈骗罪之间的界限以及盗卖、侵占不动产的认定。理论界与实务界对一房二卖行为的认定存在争议。本文从宏观上将一房二卖行为分为两种类型:一是对自身房产的二重买卖,即行为人自始至终处分的是自己的财产。二是与"一房二卖"交叉的无权处分他人不动产,即行为人在为前买受人办理权属变更登记之后,通过伪造公证书、挂失房产所有权证等方式重获房屋所有权人的身份,而使买受人误以为行为人即为房屋所有权人而与其签订房屋买卖合同。并将重点着眼于无权处分背景下的"一房二卖"行为,通过分析司法实践中出现的典型疑难案例,梳理案件相关争议焦点,探讨认定该类"一房二卖"的具体标准,并对有关疑难问题给予解答。
Some cases in the dispute of"double sales of a room"involve the boundary between civil fraud and contract fraud and the determination of theft,sale and embezzlement of real estate.Therefore,there is a dispute between the theoretical and practical circles about the identification of two sales of one house.This paper divides the behavior of one house and two sales into two types from the macro point of view:1.it is to sell one’s own house twice,namely the person disposes his own property;2.it is to sell one house two crossed with no right to dispose of property of others,namely the person,after handling the ownership change registration for the buyer,forges notarial deed,reports the loss of all the property right certificates or other way to regain the identity of the house owner,so that the buyer mistakes the offender to be the owner of the house and signs the sale and purchase contract.It will focus on the behavior of"double sales of a room"under the background of unauthorized disposal.By analyzing the typical difficult cases in judicial practice,it will sort out the dispute focus of the case,discuss the specific criteria for determining such"one house and two sales",and answer the relevant difficult questions.
