摘要
随着中美贸易摩擦的持续,知识产权侵权诉讼以及其衍生形式知识产权许可谈判开始大量涌现。知识产权保护工作关系国家安全,只有严格保护知识产权,才能有效保护我国自主研发的关键核心技术、防范化解重大风险。报告从法律环境风险、外部专利风险、竞争性风险三个维度,对科研项目立项阶段的侵权风险开展研究,形成专利侵权风险评估指标体系,设计专利侵权风险评估的计算方法,根据专利侵权风险评估分值将专利侵权风险划定为高、中、低三个等级,同时通过实际案例对专利侵权风险评估指标体系进行验证,为决策者提供辅助决策信息,帮助确定项目的必要性和可行性,避免盲目的研发生产。报告还提出了侵权应对措施,通过加强规避设计、采取对外合作,帮助企业降低风险,提升武器装备生产效率。
With the continuous Sino US trade friction,a large number of intellectual property infringement litigation and its derivative forms of intellectual property licensing negotiations began to emerge.Intellctual property protection is related to national security.Only by strictly protecting intellectual property can we effectively protect the key core technologies independently developed in China and prevent and resolve major risks.The report studies the infringement risk in the establishment stage of scientific research projects from the three dimensions of legal environment risk,external patent risk and competitive risk,forms a patent infringement risk assessment index system,designs the calculation method of patent infringement risk assessment,and classifies the patent infringement risk into high,medium and low levels according to the score of patent infringement risk assessment.At the same time,the patent infringement risk assessment index system is verified through actual cases to provide decision-makers with auxiliary decision-making information,help determine the necessity and feasibility of the project,and avoid blind R&D and production.The report also puts forward infringement countermeasures to help enterprises reduce risks and improve the production efficiency of weapons and equipment by strengthening design avoidance and foreign cooperation.
