控告申诉检察运行机理及高质量发展路径研究

控告申诉检察是检察机关法律监督体系的重要组成部分,也是回应人民群众新要求新期待的纽带。在法治化、高质量发展的理念指导下,用控告申诉替代检察信访,厘清控告申诉检察职权的内在机理,按照固本强基和系统化思维,以"理"为要、纲举目张,厘定"受理、办理、说理"三要素为基础的控告申诉检察工作机制,通过专项督查、创新增效等活动,推动提升接访办信、监督和救济等工作水平,最终实现"民有所呼、我有所应"的高质量发展。

Suing, appeal and prosecution is an important component of the legal supervision system in the procuratorial organs. It is also a bridge to respond to the new demands and expectations of the general public. Under the guidance of the notion of legalization and high-quality development, prosecution and petition by the general public is replaced by suing and appeal, and the judicial mechanism of the prosecutorial functions in suing and appeal is clarified. Following the principle of laying a solid foundation and promoting systematization, the judicial work can be carried out smoothly by clarifying the prerequisites for consolidating the theoretical basis and clarifying the working context. A working mechanism of the suing, appeal and prosecution should be established following the guidance of three principles: listening to the opinions of the general public, working for the people, and following the legal principle. The improvement of the quality of reception, handling, supervision, relief and other procedures should be promoted through activities like special supervision, innovation and efficiency improvement, to finally realize the high-quality development of "people’s needs are government’s responses".
