[目的/意义]美国337调查风险预警是重要的情报议题,对加快我国企业“走出去”、保障产业发展和维护国家安全具有现实意义。研究为如何利用专利情报来高效预警337调查提供了参考。[方法/过程]采用量化研究与案例研究相结合的方法,构建诉讼专利特征与337调查的回归模型,并将模型运用至移动通讯行业的专利侵权诉讼案件中,实现337调查情报预警。[结果/结论]337调查风险预警可以将诉讼专利作为情报源,利用概率预测模型识别出法律质量、技术质量和经济价值更高的337调查专利。企业、行业协会和政府部门可以利用情报有效规避337调查风险,满足各自的现实需求。

[Purpose/Significance]Risk early warning of 337 investigations is an important intelligence issue,which has practical significance for"going global"strategy,industrial development and national security.This study offers a reference for using patent intelligence to early warning 337 investigations efficiently.[Method/Process]This paper conducts both quantitative research and case studies.First,constructing a regression model of patent features and 337 investigations.Then,applying the model to patent infringement litigations in the telecommunication industry to realize intelligence warning.[Result/Conclusion]Risk early warning of 337 investigations can use litigated patents as an intelligence source.The prediction model can identify 337 investigation patents which have higher legal quality,technical quality and economic value.Enterprises,industry associations and government departments can use intelligence to effectively avoid 337 investigation risks.
