摘要
我国2020年《著作权法》第47条对广播组织权的范围作了一定扩张,但仍沿袭了禁止权立法模式,并重申了权利行使不得损害在先权利的基本原则。对这一条款的理解与适用,需结合著作权法相关条款和基本原理作综合解读。广播组织对不包含他人作品或录音录像制品的由其自己制作和播放的广播、电视,有权禁止他人未经许可使用,也可许可他人以《著作权法》第47条第1款规定的各种方式使用;对包含他人作品或录音录像制品的广播、电视,广播组织有权禁止他人未经许可以《著作权法》第47条第1款规定的各种方式使用,但除非有相反的明确约定或授权,广播组织不得复制发行、重播或许可他人播放其已经录制的包含他人作品或录音录像制品的广播、电视;对未经许可使用包含他人作品或录音录像制品的广播、电视的行为,著作权人、录制者和广播组织均可请求禁止。广播、电视中的他人作品或录音录像制品被第三人侵害的,损害赔偿的请求权由其权利人行使,权利人与广播组织有相反约定的除外。
The scope of the rights of broadcasting organizations has been expanded to include prohibiting illegal streaming of broadcast signals and communicating to the public of broadcast through internet when China’s Copyright Law was amended in 2020.Article 47 of the Law remains prohibiting rules other than licensing rules yet,and restates the basic copyright conception of protecting the rights of broadcasting organizations without prejudice to prior rights.This Article should be interpreted comprehensively with other related provisions in order to pursue the legislative purpose of the copyright law.Broadcasting organizations are empowered to prohibit illegal activities stipulated by Article 47,as well as issue license to make any use of their signals and fixed broadcasts,provides that there’re no works or video and audio recordings owned by others used in these broadcasts.On the contrary,broadcasting organizations cannot issue license of utilizing their broadcasting signals or fixed videos which include others’protected contents,unless otherwise clearly agreed by the right owners when the broadcasting contracts were signed.For the broadcasting contents which is actually the works or video and audio recordings of others,either the right owner or the broadcasting organization can prohibit their illegal use according to the law,yet the right of claiming damages from the infringer shall belong to the right owner,unless there’s contrary agreement in the broadcasting contract.
