存货动态质押监管人法律地位之探讨

On the Legal Status of Supervisor in Dynamic Pledge of Inventory

存货动态质押监管人法律地位不同于浮动抵押中的代管人,这是由二者在产生基础、任职资格、功能设计、权利义务内容与来源上的不同造成的。存货动态质押及其监管人不能准用浮动抵押及其代管人制度的相关规定。实践中存货动态质押监管虽然存在着监管人自营仓库监管、质物存放于第三方企业仓库监管和质物存放于出质人仓库内监管三种模式,但从监管协议内容看,无论何种监管模式,监管人均具有质权人的受托人和质物仓储保管人的身份,只是不同的监管模式会导致监管人在履行对质物的保管义务时出现程度与方式上的差异,但不会改变监管人在质押监管关系中的法律地位。

Due to the differences in foundation,qualifications,functions,content and sources of rights and obligations,the supervisor in dynamic pledge of inventory is different from the depository in the floating charge system,respective rules working in each system.In practice,there are three modes of supervision in dynamic pledge of inventory:supervision in supervisor’s own warehouse,supervision in the third party enterprise’s warehouse and supervision in the pledgor’s warehouse.However,from the perspective of regulatory agreement,no matter under what kind of supervision,the supervisor has both identity of consignee of the pledgee and custodian of the pledged goods.Different supervision modes will lead to differences in the degree and manner of the supervisor’s performance of custody obligation,but the legal status of the supervisor will not be changed.
