摘要 本文针对现有专利申请的创造性判断过程容易受主观因素影响进而影响创造性评判的客观性和公正性的问题,从大量生效的复审无效宣告请求审查决定、法院终审判决等案例中选取N件有代表性的创造性案例,找到共同的创造性判断影响因素,对有创造性和无创造性结论的主要影响因素进行分析,筛选和论证得到影响因子,并对各个指标进行权重测量,应用层次分析法、模糊综合评价法建立创造性评判模型,实现专利的创造性辅助评判。 Aiming at the problem that the creative judgment process of the existing patent application is easily influenced by subjective factors to further influence the objectivity and fairness of creative examination,the common creative judgment influencing factors are found from a large number of effective review invalid declaration request examination decisions,court final examination judgments which N representative creative cases are selected from,the main influencing factors influencing creative and non-invasive conclusion are analyzed,the influencing factors are screened and demonstrated,and weight measurement,analytic hierarchy process and fuzzy comprehensive evaluation method are carried out on each index to realize the establishment of a creative judgment model and the creative auxiliary judgment.
