摘要 算法管理是实现企业运营管理的算法化,指企业利用算法技术组织劳动者完成工作任务的一种内部管理手段和方式。由于算法管理具有虚拟性和强技术性,在提升企业运营管理效率的同时,它也给劳动者的合法权益带来了新的挑战和压力。然而,当前的劳动法规范的滞后性使其难以对作为实践创新的算法管理产生有效的规制作用,包括:与劳动规章制度有关的条款未能涵摄算法管理;劳动规章制度针对算法管理的执法效能不足;企业在运用算法管理时,对应承担的劳动规章制度责任不足。为此,亟需加强劳动法对算法管理的规制,以“趋利避害”。具体规制路径包括:将算法治理的相关理念及其行为规制等融入《劳动合同法》与用人单位劳动规章制度的相关条款中,从而在法律制度层面完成对算法管理的规制,以保护劳动者合法权益。 Algorithm management is to realize the algorithmization of enterprise operation management,which refers to an internal management method for enterprises to use algorithm technology to organize laborers to complete work tasks.As algorithmic management is virtual and highly technical,it will also bring new challenges and pressures to the legitimate rights and interests of workers while improving the efficiency of enterprise operation and management.However,the lagging nature of the current labor laws and regulations makes it difficult to produce effective regulations for algorithm management as a practical innovation,including:the provisions related to labor rules and regulations fail to cover algorithm management;labor rules and regulations aim at the law enforcement of algorithm management Insufficient efficiency;when companies use algorithmic management,they have insufficient labor regulations and responsibilities.For this reason,it is urgent to strengthen the labor law's regulation of algorithm management,so that it can realize"avoiding disadvantages while seeking advantages".The specific regulatory path includes:integrating the related concepts of algorithmic governance and its behavioral regulations into the provisions in the"Labor Contract Law"specifically relating to labor rules and regulations on employers,so as to complete the regulation of algorithm management at the legal system level to protect the legitimate rights and interests of workers.
