“三权分置”下农村土地经营权流转的法律问题研究

Reseach on the legal issues of rural land management right transfer under“separation of three rights”

“三权分置”下,土地经营权从土地承包经营权中分离出来,为了明确农村土地经营权的性质,便于流转且能向第三人主张合法权利,更便于维护当事人的合法权益。通过对土地经营权流转的现状考量,发现土地经营权流转存在登记制度不完善、纠纷解决机制不健全、管理服务滞后等问题。建议完善相关配套法律法规,规范土地经营权流转方式,加强土地经营权流转监管,完善纠纷解决机制、市场管理服务水平和社会保障体系,以更好地促进土地经营权流转,盘活农村土地。

Under the“separation of three rights”,the land management right is separated from the land contract management right.In order to clarify the nature of the rural land management right,facilitate the transfer and claim of legal rights to a third party,and facili⁃tate the protection of the legitimate rights and interests of the parties.By considering the current situation of land management right transfer,it is found that there are some problems in land management right transfer,such as imperfect registration system,imperfect dispute resolution mechanism,lagging management service and so on.It is suggested to improve relevant supporting laws and regula⁃tions,standardize the transfer mode of land management right,strengthen the supervision of land management right transfer,and im⁃prove the dispute resolution mechanism,market management service level and social security system,so as to better promote the trans⁃fer of land management right and revitalize rural land.
