司法改革语境下检监衔接制度研究

Research on the Connection System of Inspection and Supervision in the Context of Judicial Reform

全面深入推进司法体制改革,对检察机关履行法律监督职能的要求更加强化,对监察机关预防与打击职务犯罪职能的要求更加细化。监察机关对职务犯罪案件的立案调查与检察机关的审查起诉职能相互配合,相互制约,但是实务中对包括立案标准、管辖权属、强制措施、证据审查、介入侦查、案件材料移送等在内的具体衔接过程存在诸多争议,尚需解决。为了提升职务犯罪案件办案质效,节约司法资源,更好地服务于以审判为中心的刑事诉讼工作,建立健全检监衔接制度势在必行。

The comprehensive and in-depth reform of the judicial system has detailed the requirements for supervisory organs to prevent and crack down on duty crimes,and required procuratorial organs to strengthen its function of legal supervision.Hopefully,the filing and investigation of duty crime cases by the supervisory organs and the examination and prosecution functions of the procuratorial organs cooperate and restrict each other.However,in practice,there are many disputes in the specific connection process,including filing standards,jurisdiction ownership,compulsory measures,evidence examination,intervention in investigation,and case material transfer,etc.,that need to be solved.In order to improve the quality and efficiency of handling duty crimes,save judicial resources,and better serve the trial-centered criminal litigation work,it is imperative to establish and perfect the connection system between inspection and supervision.
