“一带一路”合作机制中国际软法效力的完善路径

On the Perfect Path to the Effectiveness of International Soft Law Under the Belt and Road Cooperation Mechanism

国际软法是“一带一路”合作机制的重要组成部分。国际软法的效力也受到了大国权力政治和利益分配冲突的外部因素制约,国际软法会加剧国际法碎片化现象,制定程序不够严谨也影响了其效力的发挥。为完善“一带一路”合作机制中国际软法的效力,文章提出要树立“人类命运共同体”理念,破除狭隘国家利益观,探寻新的国际软法制定模式,并实现国际软法制定过程中的实质民主。

International soft law is an important part of the"Belt and Road"cooperation mechanism.The characteristics of international soft law are non-obligation,soft restraint and no hierarchy,and its effectiveness has a certain theoretical and practical basis from two perspectives of normative rationality and subjective rationality.But at the same time,the effectiveness of international soft law is also restricted by external factors such as power politics and conflicts in the distribution of interests of major powers.International soft law will aggravate the fragmentation of international law,and the lack of rigor in formulating procedures also affects its effectiveness.In order to improve the effectiveness of international soft law under the Belt and Road cooperation mechanism,it is proposed to establish the concept of a"community with a shared future for mankind",break away from the narrow view of national interests,and explore new international soft law formulation models,and realize the essence of the international soft law formulation process democracy.
