明确新冠肺炎患者隐私暴露人群的范围,梳理国内外对于公民健康信息保护的法律法规,分析当前国内在新冠肺炎患者隐私保护方面存在的主要问题,包括有关人员的隐私泄露风险、隐私过度保护问题,潜在的个人利益与公众利益冲突等。针对发现的问题提出具体建议,如禁止披露与抗疫目的无关的个人隐私信息,一定范围内接受、降低、规避隐私泄露风险,完善新冠肺炎患者隐私的立法保护等。

Clarified the scope of privacy exposure of COVID-19 patients,sorted out the laws and regulations on citizen health information protection at home and abroad,and analyzed the current major problems in the privacy protection of COVID-19 patients in China,including the privacy disclosure risk of relevant personnel,excessive protection of privacy,and potential conflicts between personal interests and public interests,etc.Specific suggestions were put forward for the problems found,such as prohibiting the disclosure of personal privacy information unrelated to the purpose of fighting the epidemic,accepting,reducing and avoiding the risk of privacy disclosure within a certain extent,and improving the legislative protection of the privacy of COVID-19 patients.
