摘要
共建“一带一路”高质量发展是“十四五”重点规划之一,然而近几年中资企业在“一带一路”倡议建设中面临各类劳动风险事件,造成极大的损失。劳动标准制度差异带来的信息不对称和制度摩擦是产生劳动关系风险冲突的主要因素,通过搜集相关制度数据,“一带一路”沿线国家劳动标准制度在国家间和区域间具有明显的差异性,对中资企业具有不同的制度和成本优势影响。中资企业应通过加强合规管理、完善劳资纠纷和预警机制以及提升跨国管理水平等防控劳动关系风险。
The joint construction of the Belt and Road high-quality development is one of the key plans of the“14th Five-Year Plan”.However,in recent years,Chinese-funded enterprises have faced various labor risks in the Belt and Road construction,which causes great losses.The information asymmetry and system friction caused by the differences in labor standard systems are the main factors that cause labor relationship risk confl icts.By collecting relevant system data,the labor standard systems of countries along the Belt and Road have obvious differences between countries and regions.Therefore,systems and cost advantages for Chinese-funded enterprises are varied.Chinese-funded enterprises should prevent and control labor relationship risks by strengthening compliance management,improving labor disputes and early warning mechanisms,and enhancing cross-border management.
