国内外地理标志保护管理体制的演变与趋势

地理标志保护在国际层面以南欧国内法的探索与发展、多边协定的调适与妥协、双边及区域性谈判的重塑与整合为演变主线;国内层面则经历了由引入到探索、认同到发展、无序到规范之转化。当前地理标志国际保护纷争短期内无法达成一致共识且国内复合保护模式经机构改革后仍饱受政学两界争议。如何应对地理标志国际保护冲突,并依据国际保护演变趋势与本国实际调整相关保护模式与标准亟须予以重点考虑。新形势下,对国内外地理标志保护工作进行阶段性梳理,有助于明晰地理标志保护演变路径所在与发展趋势所向。

At the international level,the main line of evolution is the exploration and development of domestic laws in southern Europe,the adjustment and compromise of multilateral agreements,and the reshaping and integration of bilateral and regional negotiations.At the domestic level,the transformation from introduction to exploration,identification to development,disorder to norm is experienced.At present,no consensus can be reached on the international protection of Geographical Indications in a short period of time,and the domestic composite protection model is still controversy between political and academic circles after the institutional reform.How to deal with the conflicts of international protection of Geographical Indications and how to adjust the relevant protection models and standards according to the evolution trend of international protection and the actual situation of the country should be given urgent consideration.Under the new situation,a phased review of the protection of Geographical Indications at home and abroad is helpful to clarify the evolution path and development trend of the protection of Geographical Indications.
