法学博硕学位论文评议失当的问题分析与规制建议

On the Analysis and Suggestion of Regulating the Improper Academic Evaluation on Graduate Master’s Thesis and Doctoral Dissertation in Jurisprudence

博硕研究生学位论文匿名同行评议对保障和促进我国高等教育的学位论文水平发挥了巨大的作用。然而,不能排除存在有失客观、公正、科学的评审失当行为。本文归纳分析了学位论文评议失当的种种表现。鉴于学位论文评审权是一种鉴定和判断性质权力,具有自由裁量性,其与学生学位、指导教师和学位授予单位存在重要利害关系,故有对学位论文评议失当行为加以规制的必要。需健全学位论文评审规则、科学使用评议结论、保障和维护学生的申诉权等。

Anonymous dissertation peer review process for PhD and master of jurisprudence plays an important role in improving the quality of dissertations in China’s higher education.However,it is inevitable that some experts do not take an objective,fair and scientific approach to evaluate their papers.This article summarizes and analyzes practices of improper evaluation on graduate thesis and dissertation.Given the fact that the rights of dissertation review is a way of appraisal and judgment and is therefore discretionary,and that the evaluation process is vital to students’degrees,university mentors and degree-granting institutions,it is necessary to curb the practices of misconduct in thesis evaluation.The regulatory countermeasures were adopted as follows:optimizing evaluation instructions,taking a scientific approach to evaluation results,safeguarding and maintaining students’rights of an appeal request,etc.
