我国著作权法视域下的人工智能法律主体资格论证

On the Qualification of Artificial Intelligence Legal Subject From the Perspective of China's Copyright Law

智能经济时代下人工智能技术的发展,不断改变着人类主体的生产和生活方式。相比于其他技术成果,人工智能所具备的“自主性”与“智能化”,既给人类生活带来了便利和高效,也使得人工智能“算法黑箱”逐渐显现、智能驾驶汽车侵权责任承担机制缺失以及人工智能生成物利益保护协调乱序等问题日益突出。因此,为破解人工智能技术发展所带来的理论与实践困境,本文以新《著作权法》的实施作为时代背景,条分缕析人工智能在民法与著作权法中存在的法律主体资格争议,认为人工智能因具备民事权利能力和民事行为能力而可被纳入法人主体范畴,进而人工智能可因此成为著作权人,人工智能生成物作为“其他智力创造成果”被认定为作品。

In the era of intelligent economy,the development of artifi cial intelligence technology is constantly changing the production and life style of human subjects.Compared with other technological achievements,the"autonomy"and"intelligence"of artificial intelligence not only bring convenience and efficiency to human life,but also make the"algorithm black box"of artificial intelligence gradually appear,the lack of tort liability mechanism of intelligent driving vehicles,and the problems of interest protection,coordination and disorder of artifi cial intelligence products have become increasingly prominent.Therefore,In order to solve the theoretical and practical diffi culties brought by the development of artifi cial intelligence technology,taking the implementation of the new copyright law as the background of the times,this paper analyzes the disputes over the legal subject qualification of artificial intelligence in civil law and copyright law,and makes it clear that artificial intelligence can be included in the category of legal person subject because it has the ability of civil rights and civil behavior,Further,artifi cial intelligence can become the copyright owner,and the products of artificial intelligence are recognized as works as"other intellectual creation achievements"
