论中国特色人权刑事司法保障的逻辑进路

On the Logical Approach of Criminal Judicial Protection of Human Rights with Chinese Characteristics

我国刑事司法领域与人权保障密切相关,明确人权刑事司法保障所遵循的内在逻辑是推动中国特色人权刑事司法保障体系构建的应有之义。从历史演进逻辑、我国不同时期司法社会效能的演变逻辑以及新时代司法发展逻辑中,能分析出人权保障与刑事司法的内在逻辑契合度。本文通过递进式的实践框架,从宏观上人权刑事司法保障制度化改革、中观上人权刑事司法程序公开化落实、微观上刑事诉权有效性保障三个层面入手,探析人权刑事司法保障逻辑在司法实践中的具体发展进路。

The field of criminal justice in China is closely related to human rights protection.Clarifying the internal logic followed by human rights criminal justice protection is the due meaning of promoting the construction of human rights criminal justice protection system with Chinese characteristics.This paper analyzes the internal logical fit between human rights protection and criminal justice from the historical evolution logic,the evolution logic of judicial social efficiency in different periods,and the judicial development logic in the new era.Through the progressive practical framework,this paper analyzes the specific development approach of the logic of human rights criminal justice protection in judicial practice from three aspects:the institutionalized reform of human rights criminal justice protection at the macro level,the open implementation of human rights criminal justice procedure at the meso level,and the effective protection of criminal litigation right at the micro level.
