打击网络犯罪国际合作的现实困境与优化举措

The Realistic Predicament and Optimization Measures of International Cooperation against Cybercrime

当前网络犯罪问题发展态势严峻,已成为世界各国共同面对的难题,单纯以一国国内法的应对已明显不足,网络犯罪治理的现实困境呼唤着各国间国际合作的再深化。通过梳理打击网络犯罪国际合作的发展现状,指出区域性网络犯罪治理与网络犯罪公约所存在的不足。基于此,应充分发挥联合国在协调网络犯罪国际合作中的作用,尽快制定切实有效的全球性网络犯罪公约,强化各国国内立法与国际性公约的协调与衔接,并持续提升各国打击网络犯罪的技术保障水平,维护世界网络空间安全。

Recently the development of cybercrime is grim,and it has become a serious problem faced by all countries in the world.It is obviously insufficient to deal with it simply under one country’s domestic law.The difficulty of cybercrime governance calls for further deepening of international cooperation among countries.This paper points out the shortcomings of regional cybercrime governance and cybercrime convention by combing the development status of international cooperation against cybercrime.It is necessary to give full play to the role of the United Nations in coordinating international cooperation on cybercrime,formulate an effective global convention on cybercrime promptly,strengthen the coordination and convergence between national legislation and international conventions,and continuously improve the technical support level of various countries in combating cybercrime,so as to safeguard the security of the world cyberspace.
