经济法立法评估是促进经济法实施,提升经济法治绩效的重要手段。我国现行经济法立法评估形式化倾向严重,存在评估对象选取不均衡、评估主体结构单一、评估指标欠缺科学性与体系化、评估结果反馈与应用机制缺乏等问题,无法回应新时代经济社会发展的新需求、新挑战。为提升经济法立法质量与实施绩效,真正实现经济法立法决策、制度设计、法律实施与结果反馈的良性循环,需升华经济法立法评估目的,优化经济法评估模式,设置契合经济法内在属性的评价指标与体系,并通过优化评估结果应用的规范性与约束性等制度建构,体现经济法立法对经济社会发展的回应性,实现经济法立法评估的法治化运行。

The legislative evaluation of economic law is an important means to promote the implementation of economic law and improve the performance of economic rule of law.The formalization of reassessment in China’s current economic law legislative evaluation leads to some problems,such as unbalanced selection of assessment objects,single structure of assessment subjects,lack of scientific and systematic evaluation indicators,lack of feedback and application mechanism of evaluation results,etc.Which can not respond to the new demands and challenges of economic and social development in the new era.For improving the quality of the economic law legislation and implementation of the performance,truly realize the virtuous circle of economic law legislative decision-making,system design,law implementation and result feedback,it is necessary to upgrade the purpose of economic law legislative evaluation,optimize the economic evaluation model,set up a system that fits the inherent attributes of economic law,and through the optimization of the normative and restrictive application of the evaluation results,reflect the responsiveness of economic law legislation to economic and social development,realize the rule of law operation of economic law legislation evaluation.
