纷纭旋转之间:新兴技术回应型立法的舆论引导--以胚胎嵌合体为例

Different Spins:Human-animal chimeras as a guide to public opinion on responsive legislation for new biotechnologies

胚胎嵌合体的实证研究显示,日本政府批准人-动物嵌合体实验的新动向引起全球的关注,而国内媒体面对这一有伦理争议的前沿生物技术新发展,相关报道在标题和正文中均缺乏必要的科学话语。这显然不利于引导全社会理性的思考和对话,影响人们对存在伦理争议的前沿科学实验的审慎观察,甚至可能使公众对此产生恐慌,加剧了促成社会多元共识的难度。这一现象也与已有的研究观点相悖,即媒体从以普法为核心的法制宣传期到与司法频繁互动的舆论监督期,参与了我国法治实践的方方面面。因此,舆论引导是迫切需要研究的问题。在回应型立法占据生物科技立法主导地位时,立法者、政策制定者和社会公众需要更多关注舆论导向的负面作用。如何实现媒体和生物新技术伦理法律的有效互动,是当前我国生物科技法律语境的一个需要迫切解决的难题。

The empirical study of human-animal chimeras shows that the new trend of the Japanese government approving human-animal chimera experiments has attracted global attention.In the face of this ethically controversial new development in cutting-edge biotechnology,domestic media reports lack the necessary scientific discourse in both headlines and text.This is obviously not conducive to guiding rational thinking and dialogue in society as a whole,affecting people's prudent observation of ethically controversial frontier scientific experiments,and may even make the public panic about them,which makes it more difficult to foster a pluralistic social consensus.This phenomenon also contradicts the view of existing studies that the media has participated in all aspects of China's law practice from a period of legal propaganda centered on the popularization of law to a period of public opinion supervision with frequent interaction with the judiciary.Therefore,the guidance of public opinion is an urgent issue to be studied.When responsive legislation dominates biotechnology legislation,its negative effects require multiple concerns from legislators,policy makers and the public.How to achieve effective interaction between media and ethical laws of new biotechnology is a difficult problem that needs to be urgently solved in the current legal context of biotechnology in China.
