信息网络传播权刑法保护反思与诠释

Reflection and Interpretation on Criminal Law Protection of Information Network Communication Right

司法解释为回应现实需求,将“通过信息网络传播他人作品的行为”视为《刑法》第217条规定的“复制发行”,这是用传统线下治理的思维方式进行线上治理。《刑法修正案(十一)》将信息网络传播权纳入刑法保护是规范作品网络传播的重要举措。侵犯著作权罪具有双重违法性,在双重违法之间存在位阶关系,著作权法是前置规范,刑法是二次规范。对侵犯信息网络传播权犯罪的认定应坚持先定侵权后定罪的二次违法标准,并且对著作权法与刑法中的相同概念应作同义解释。《刑法修正案(十一)》生效后,对司法解释与实践经验进行反思总结,及时清理相关司法解释,坚持民刑衔接的体系思维,正确解释适用刑法规范,才能够实现法律体系内部和谐的规范效果。

Judicial interpretation regards"the act of spreading others'works through information network"as the"copy and distribution"stipulated in Article 217 of Criminal Law in response to the realistic demand,which is the thinking mode of offline governance for online governance.It is an important measure to standardize the network dissemination of works to include the right of information network dissemination into the protection of criminal law in the Amendment of Criminal Law(XI).The crime against copyright has dual natures.There is a hierarchy relationship between those dual illegalities.The copyright law is the prepositive norm,and the criminal law is the secondary norm.The identification of the crime of infringing on the right of information network communication should adhere to the double illegality standard,and the same concepts in the copyright law and the criminal law should be explained synonymously.After the enactment of the Amendment of Criminal Law(XI),we should reflect and summarize the judicial interpretation and practical experience,modify the relevant judicial interpretation on time,adhere to the system thinking of civil and criminal convergence,and correctly interpret and apply the criminal law norms,so as to achieve the normative effect of harmony within the legal system.
