地方立法视域的民族团结进步创建研究

On the Establishment of National Unity and Progress from the Perspective of Local Legislation

民族团结进步创建工作在全国各地实施后取得了很大成效,也存在一定不足。在理念层面,各省市"条例"中规定的"民族"多指中华民族,忽视了民族认同的深远意义,致使相应"条例"的接受度不高。民族认同是中华民族认同的关键一环,正确认识各民族间的差异是推进中华民族认同的基石。在制度层面,相关立法还处于空白状态,应在民族团结进步创建工作中推进两大认同。对民族认同,通过地方立法予以明文确认,实现从"无"到"有";对中华民族认同,具象现行制度,实现从"宽"到"细"。通过对民族认同与中华民族认同的差异与联系的深入探究,寻找现行民族团结进步创建工作中存在的问题,为构建我国民族团结进步创建工作提供具体路径。

The establishment of national unity and progress has achieved great results after it has been implemented in various parts of the country, but there are also some deficiencies. At the conceptual level, the "nation" stipulated in the regulations of various provinces and cities mostly refers to the Chinese nation, ignoring the far-reaching significance of national identity, resulting in the low acceptance of the corresponding regulations. National identity is a key part of Chinese national identity, and a correct understanding of the differences among ethnic groups is the cornerstone of promoting Chinese national identity. At the institutional level, the relevant legislation is still in a blank state, and the two major identities should be promoted in the establishment of national unity and progress. The national identity should be explicitly established through local legislation to realize the change from "nothing" to "being", and the identity of the Chinese nation, like the current system, from "broad" to "fine". Through an in-depth study of the differences and relations between national identity and Chinese national identity, this paper tries to find out the problems existing in the current work of the establishment of national unity and progress, so as to provide a specific path for the construction of the work of national unity and progress in China.
