论土地征收成片开发的公益性补强 被引量:2

摘要 土地征收成片开发的公益性弱化加大了地方政府滥用征收权的风险,危及了被征地农民的合法权益,"挤压"了集体建设用地入市制度的适用空间。为避免阻滞国民经济社会发展和城镇化建设进程,采用规范分析法和文献研究法,对比各省级政府公布的《土地征收成片开发标准实施细则》,将成片开发归纳为扩张型和限缩型,阐述成片开发的公益性存在弱化现象,分析成片开发征收公益性弱化的潜在法律风险,并将土地征收成片开发制度嵌入公私利益平衡框架之中,有针对性地提出法律补强建议,以期为推进城镇化建设和保护被征地农民合法权益提供助力。 The weakening of public welfare of land expropriation tract development increases the risk of local governments abusing the expropriation power,endangers the legitimate rights and interests of the farmers,and“squeezes”the applicable space of the collective construction land market system.In order to avoid blocking the process of national economic and social development and urbanization,this paper used normative analysis method and literature research method to compare the“Detailed Rules for the Implementation of Land Expropriation Standards for Tract Development”published by provincial government,sumed up the tract development into expansion type and limitation type,expounded the weakening phenomenon of the public welfare of tract development.This paper analyzed the potential legal risks of the weakening of public welfare,and embedded the land expropriation tract development system in the public and private interests balance framework,put forward targeted legal reinforcement recommendations,in order to promote urbanization construction and protect the legitimate rights and interests of the expropriated farmers to provide help.
