新冠肺炎在全球蔓延给我国海外工程项目建设造成了严重影响。面对这场全球性流行病,企业合理引用合同中不可抗力条款捍卫己方权益非常重要。介绍了不可抗力索赔背景、认定和索赔时效,指导企业收集COVID-19不可抗力索赔的资料和工期费用的计算方法,并介绍了在索赔中应注意的其他问题,旨在更好地为企业科学运用合同中不可抗力条款应对COVID-19对海外工程项目造成的影响,保护企业权益。

The global spread of COVID-19 has had a serious impact on China's overseas engineering projects.Facing this global epidemic,it is very important for companies to properly use force majeure clauses in their contracts to protect their rights and interests.In this paper,the background,acknowledgment and claim time limit of force majeure claim are introduced,the guidance for enterprises to collect force majeure claim information of COVID-19 and the methods of schedule and cost calculation are put forward,as well as the other problems needing attention in the claim.The purpose is to scientifically implement force majeure clauses better to deal with the impact of COVID-19 on overseas projects and protect rights and interests of enterprises.
