摘要
建立新就业形态人员职业伤害保险制度,已提上国家议事日程。新就业形态人员职业伤害保险需要突破现有法律法规规定、解除劳动关系的关联、化解税务和劳动能力鉴定的窘境、减轻平台企业负担等方面的难点。综合国内一些省市先期进行新就业形态人员职业伤害保险试点的经验做法来看,北京市建立新就业形态职业伤害保险制度可供选择的路径主要有三种:纳入现行工伤保险制度统筹管理,建立独立运行的职业伤害保险制度,以及建立强制性商业保险制度。
Establishment occupational injury insurance system for new employment forms has been put on the national agenda.Occupational injury insurance for new employment forms needs to break through the existing laws and regulations,remove the association of labor relations,solve the dilemma of tax and labor training,and reduce the burden of platform enterprises.Based on the experience and practice of some provinces and cities in China in conducting pilot occupational injury insurance for new employment forms,there are mainly three pathways for Beijing to establish the occupational injury insurance system for new employment forms:to integrate it into the overall management of the existing industrial injury insurance system,to establish an independent occupational injury insurance system,and to establish a mandatory commercial insurance system.
