国际工程管理工作中FIDIC合同索赔的探讨

On FIDIC contract claims in international project management

随着国家“一带一路”大海外战略的实施,建筑及建筑类的配套产业作为“互联互通”项目首先受益,海外建筑市场潜力巨大,中国建筑企业以此为契机,不断深入国际合作、加快“走出去”步伐。机遇与挑战并存,在获得更多国际工程项目机会的同时,中国企业也面临来自各方面的风险与挑战。从承包商的角度,重点对FIDIC合同条件下的国际工程索赔的内容和原则进行研究,进而指出如何通过FIDIC合同进行项目工期和费用索赔,识别索赔机会,以规避风险。

Along with the implementation of the overseas strategies of the Belt and Road Initiative,the relative industries with the architecture and its types will be beneficial firstly as the interconnectivity program,so it will be the golden chance for Chinese architectural enterprises with the huge potential in overseas architectural market to continuously deepen the international cooperations and accelerate the pace of the“Go Global”Strategy.The paper indicates that while obtaining more chances from the international programs,the Chinese enterprises may also encounter all kinds of risks and challenges,researches the contents and principles for the international project claims under the FIDIC contract from the view of contractors,and points out the ways of undertaking the claims on the construction duration and claims under the FIDIC contract and to identify the claim chances to avoid risks.
