摘要
2005年国务院修改《信访条例》后,各地、各部门制定出台了多项地方配套法规政策,形成了以宪法为统领,以《信访条例》为基本框架,以地方信访法律规范、党政机关信访法律规范以及司法解释类信访文件等为主要内容的信访法律规范体系。结合全面推进依法治国的时代背景,本文详细阐述了信访法律规范体系涵盖的主要内容,以及它与其他法律规范之间的关系,揭示出当下信访法律规范体系存在的“制度功能定位变化”、“法律规范位阶较低”和“立法体系庞杂且松散”等系列问题。
After the revision of Regulations on Letters and Calls by the State Council in 2005,local people's congresses,governments and relevant departments have adopted the Regulations as the main line,and formulated a number of local supporting laws and policies.A legal and normative system for complaint reporting has been formed,with the Constitution as the guide,the Regulations on Letters and Calls as the basic framework,and the legal norms for public complaints and proposals of local government and of Party and government organs,and judicial interpretation of public complaints and proposals documents as the main contents.In combination with the time background of promoting the rule of law,this paper elaborates the main contents covered by the legal and normative system of public complaints and proposals,as well as the relationship between it and other legal norms,and reveals a series of problems existing in the current legal and normative system of public complaints and proposals,such as“the change of institutional function orientation”,“the low rank of legal norms”,and“the complex and loose legislative system”.
