恶势力犯罪司法认定的实务观察与规制匡正——以C市Y地区司法实践为分析样本

随着扫黑除恶工作的不断深入,司法实践中逐渐呈现出相关的各种新情况、新问题。恶势力犯罪与黑社会性质组织犯罪不同,其是先有司法实践和惩罚处理的需求,后才有相应司法解释。因相应立法的相对滞后,司法机关在打击恶势力犯罪过程中存在的分歧和问题不断出现。从C市Y地区司法机关的实务工作进行观察审视,当前的恶势力犯罪司法认定工作中还存在着刑法罪名不全面造成定罪量刑不规范,违法事实与犯罪事实重复评价处理,恶势力在法律文书中的表述不统一等问题。为科学合理地认定恶势力违法犯罪活动和明晰相应刑罚标准规范,有必要从限制恶势力罪名的认定范围,提高违法活动的认定门槛,合理描述法律文书中的恶势力等方面进行改进,务求完备,力臻实效。

With the continuous deepening of the anti-criminal work,various new situations and new problems have gradually emerged in judicial practice.Crimes by evil forces are different from underworld-organized crimes.They have the require of judicial practice and punishment before corresponding judicial interpretations.Due to the relative lag of the corresponding legislation,the differences and problems existing in the judicial organs in the process of cracking down on the crimes by evil forces continue to appear.Observing and examining the actual work of judicial organs in C city Y area,there are still issues such as incomplete criminal charges resulting in irregular convictions and sentencing,illegal facts and criminal facts are repeatedly evaluated and dealt with,and inconsistent expressions of evil forces in legal documents in the current judicial identification of crimes by evil forces.In order to scientifically and reasonably identify the criminal activities of evil forces and clarify the corresponding penal standards,it is necessary to limit the scope of identification of crimes by evil forces,raise the threshold for identifying illegal activities and reasonably describe the evil forces in legal documents,to strive to achieve practical results.
