营造上海金融法治试验区的思考

Thoughts of Constructing a Financial Pilot Zone for the Rule of Law in Shanghai

金融的发展离不开法治的保障,在“十四五”时期上海打造全球金融中心的新发展格局下,金融法治高地建设也是题中之义。其中,发挥自贸区临港新片区先行先试的“试验田”功能,建立金融法治试验区十分必要。本文就借鉴域外金融中心金融法治的经验,从金融立法、金融司法以及金融监管等方面对试验区的营造提出规划建议,对标国际一流标准,助力上海打造比肩纽约、伦敦的全球金融中心。

The development of finance is inseparable from the guarantee of the rule of law.Under the new development pattern of Shanghai's construction of a global financial center during the"14th Five-Year Plan"period,the construction of a highland of financial rule of law is also the meaning of the topic.Among them,it is very necessary to give full play to the"experimental field"function of the Lingang New Area of the Free Trade Zone,and to establish an experimental zone for financial rule of law.This article draws on the experience of financial rule of law in foreign financial centers,proposes planning suggestions for the construction of the pilot zone from the aspects of financial legislation,financial justice,and financial supervision,benchmarking against international first-class standards,and helping Shanghai build a global financial center comparable to New York and London.
