论墨西哥海外侨胞权保障及其对我国的启示

On the Protection of the Rights of Mexican Diaspora and Its Enlightenment to China

墨西哥海外侨胞权保障大致经历了严格管控、自由放任、积极保护三个阶段的历史演变,最终实现了根本性的突破。根本性突破的内在逻辑在于对“不干涉原则”的重新定义,以及海外侨胞治理逻辑的深刻转变;根本性突破的法律基础是双重国籍制度的确立。在承认双重国籍的基础上,墨西哥不断完善侨胞权保障组织体系,努力寻求双边和区域合作,不遗余力保护海外侨胞权益,并因此成功将海外侨胞由墨西哥的“资源消耗”转变为“资源收益”。墨西哥的成功经验对于我国侨胞权保障制度的构建具有重要的启示意义。

The protection of the rights of Mexican diaspora has experienced three phases from strict control to a laissez-faire policy and then to active protection,and finally achieved a fundamental breakthrough.The internal logic of the fundamental breakthrough includes the redefinition of the principle of“non-intervention”and the deep shift in the logic of governing of oversea Mexican.The legal foundation for the fundamental breakthrough is the dual nationality legislation.Based on recognizing dual nationality,Mexico has continuously improved the organizational structure and sought bilateral and regional cooperation to serve its diaspora.Through sustained efforts to maintain the rights and interests of Mexican diaspora,Mexico has remarkably transformed its diaspora from“resource drain”to“resource gain”.The successful experience of Mexico has great significance to provide guarantee for oversea Chinese.
